This English translation is provided for convenience only. Only the French version is legally binding; in case of any difference, the French version prevails.
These terms of use (the “Terms of Use”, in French “CGU”) govern access to and use of the brakordetail.fr website and the BrakorDetail software, published by Adam BEZIOUNE, sole proprietorship trading under the name BrakorDetail (“BrakorDetail”). The financial terms of the subscription are set out in the terms of sale.
1. Definitions
- Service: the BrakorDetail software available online (management of customers and vehicles, scheduling, quotes and invoices, online booking, customer portal, inspections, reminders, statistics…).
- Subscriber: the professional who has subscribed to a plan and has a space.
- User: any person with access to a space (the Subscriber and the colleagues they invite).
- End customer: the Subscriber’s customer who uses a page published on behalf of the Subscriber (online booking, customer portal, link to a quote or an invoice).
- Visitor: any person browsing the brakordetail.fr website.
2. Acceptance
Using the website and the Service constitutes acceptance of the Terms of Use. When creating an account, the User expressly accepts them. They can be consulted at any time at the bottom of every page of the website.
3. Access to the Service
The website is freely accessible. Access to a space requires an active subscription (or access granted by BrakorDetail) and a personal account. Each space is published at its own address (a subdomain of brakordetail.fr or the Subscriber’s domain).
The demonstration space is public: its data is fictitious and reset every night. It must not contain any real data, in particular no personal data.
4. Account and security
- The User provides accurate information and keeps it up to date.
- Their login details are personal and confidential. They choose a strong password; two-factor authentication is strongly recommended and may be required by the Subscriber for their team.
- Any action carried out with their login details is deemed to have been carried out by them. If they have any doubt about the security of their account, they change their password, close their sessions from “My account” and inform BrakorDetail.
- The Subscriber manages their colleagues’ access and roles and is responsible for their use of the Service.
5. Rules of use
The User undertakes to use the Service in accordance with the applicable laws and for its professional purpose. The following are prohibited in particular:
- entering or distributing unlawful, defamatory or infringing content, or content that violates the rights of third parties;
- sending, through the Service, unsolicited messages or messages unrelated to a service (emails are used for reminders, documents and review requests sent to the Subscriber’s own customers);
- any attempt at unauthorised access, circumvention of security measures, mass extraction or overloading of the Service, and the introduction of malicious code;
- reselling, renting or making access to the Service available to unauthorised third parties.
The Subscriber remains solely responsible for the data they enter, for the relationship with their customers and for the compliance of their commercial documents (VAT rates, mentions specific to their activity, terms of sale).
6. Pages for end customers
Booking pages, the customer portal and links to quotes and invoices are published on behalf of the Subscriber. The services, prices, time slots, deposits and conditions displayed are the Subscriber’s sole responsibility; BrakorDetail is only their technical provider. Any complaint about a service must be addressed to the Subscriber concerned.
Online payments on these pages are processed by Stripe on behalf of the Subscriber; BrakorDetail never has access to card numbers.
7. Availability
BrakorDetail endeavours to keep the Service available at all times, under a best-efforts obligation. Access may be interrupted for maintenance or updates, or in the event of an incident, a provider outage or force majeure. Data is backed up every night.
8. Intellectual property
The Service, its code, its interfaces, and the BrakorDetail brand and logo are the property of the publisher. For the duration of the subscription, the Subscriber and their Users have a personal, non-exclusive and non-transferable right of use, limited to their professional needs.
The Subscriber retains all rights to the data and content they enter. They authorise BrakorDetail to host and process them only to the extent necessary to provide the Service.
9. Liability
BrakorDetail provides management tools; it is up to the Subscriber to check the information and documents they produce with the Service. BrakorDetail cannot be held liable for content entered by Users, for the use they make of the Service, or for third-party services (Stripe, email providers, Google, email operators). The limitations of liability applicable to the Subscriber are set out in the terms of sale.
10. Suspension
In the event of a breach of the Terms of Use, BrakorDetail may suspend the access of the User concerned after a formal notice that has remained without effect, or immediately in the event of a serious breach (security breach, manifestly unlawful content, abusive sending of messages).
11. Personal data
The processing carried out by BrakorDetail is described in the privacy policy. For the data of the Subscriber’s customers, BrakorDetail acts as the Subscriber’s processor, under the conditions set out in the appendix to the terms of sale.
12. Changes to the Terms of Use
BrakorDetail may change the Terms of Use, in particular to follow changes in the Service or in regulations. Users are informed of significant changes; continuing to use the Service after they come into force constitutes acceptance.
13. Governing law
The Terms of Use are governed by French law. Any dispute is first subject to a search for an amicable solution before any action; failing that, the French courts have jurisdiction under the conditions set out in the terms of sale.
